House Action

By a vote of 107 to 76, the House has sent HB 1950 to the State Senate for further consideration.  The bill authorizes Counties to impose by ordinance an impact fee of $160,000 over a 10 year period and makes multiple changes to the regulation of oil and gas exploration.  More details to follow in this week’s edition of Marcellus Minutes.

House stops debate on Impact Fee bill at 11 pm on 11.15...debate resumes on 11.16 at 11 am

Senate Action

The Senate has defeated all attempts to amend SB 1100 on the floor and passed it by a vote of 29 to 20.  The bill will head to the House next where the Speaker will refer it to a standing committee for further consideration.

House Action

The House has supported the ruling of the chair that severance tax amendments to HB 1950 are out of order.

House Speaker Sam Smith has ruled that all severance tax amendments filed to the impact fee bill, HB 1950, are out of order.  Vitali is challenging the ruling.

Senate Action

The Senate Appropriations Committee further amended SB 1100 today with another amendment sponsored by Senator Scarnati.  Senator Scarnati explained that the impact fee would constitute the equivalent of a 3% severance tax.  The amendment also contains a production factor.  Further, the amendment contains environmental safeguards and local control language that the Senator said had the support of local government groups.

The amendment and bill passed on mostly partisan lines with Senator Wozniak voting with the Republicans.

The Republicans & Democrats are heading to caucus at 2:00 and are expected to return to the floor at 5:00 pm.

The House has scheduled Marcellus Impact Fee and Regulatory bill, HB 1950,  for a vote today. House Republicans will gavel in at 1:00 and go to caucus to discuss nearly 100 amendments.

The Senate Appropriations Committee is scheduled to further consider SB 1100 today as well.
